 Terms of Sale - This Travel Agency Travel with the Magic is merely an agent for the Suppliers identified on your travel documents. We do not directly supply travel related products such as air and ground transportation, hotel accommodations, meals, cruises, tours, etc. Because of that, this Travel Agency is not responsible for breach of contract or any intentional or careless actions or omissions by suppliers, which result in any loss, damage, delay, or injury to you or your companions or group members. Unless the term "guaranteed" is specifically stated in writing on your tickets, invoice or reservation itinerary, the Travel Agency does not guarantee any of the suppliers' rates, bookings, reservations, connections, scheduling, or handling of personal effects.

 Our cruise agents and affiliates are not responsible for any injuries, damages, or losses caused to any traveler in connection with terrorist activities, social or labor unrest, mechanical or construction failures, or difficulties, diseases, local laws, climatic conditions, abnormal conditions or developments, or any other actions, omissions, or conditions outside the agent's or affiliates control. As the traveler, you assume complete and full responsibility for (and hereby release Travel with the Magic and its agents and affiliates from) any duty of checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safety and security conditions of such destinations, during the length of the proposed travel. By embarking upon your travel, you voluntarily assume all risks involved in such travel, whether expected or unexpected. For information concerning possible dangers at international destinations, contact the Travel Advisory Section of the U.S. State Department, 1-202-647-5225. For medical information, call the U.S. Center for Disease Control, 1-404-332-4559. National Passport Information Center can be reached at 1-877-487-2778. As the traveler, you are hereby warned of the above risks as well as possible travel industry bankruptcies and medical and climatic disruptions, and are advised to obtain appropriate insurance coverage against them. Your travel specialist can provide additional details on your Travel protection coverage options upon request. The acceptance of tickets, reservations, or bookings after issuance constitutes consent to the above and an agreement on your part to convey the contents to your travel companions or group members. Please be aware that any foreign country, including Canada, may deny entrance to anyone with any type of criminal record.

 Cancellations & Supplier fees: Airlines and Suppliers can and will impose penalties on vacations that are canceled and any fees charges to you are based on that Supplier or Airlines. The Terms & Conditions are not those of Travel with the Magic. We do not charge fees for cancellations, if you are charged a fee it is from the Supplier or Airline. Airline flight delays are common and if your flight is delayed for any reason the airlines are not required by law to pay your expenses when traveling to your Destination, such as hotels, meals, car rental, car service, taxi, and phone calls. Please consider this when accepting or declining travel insurance. Please view the applicable rules before you make your reservation.

 Check your documents: When you receive your booked vacation itinerary please review it thoroughly to make sure it is correct. Please check dates, names, DOB, passport information, rates, and package inclusions. If there is an issue contact your vacation planner or guestservices@travelwiththemagic.com If you make a change to your reservation make sure you get a new updated confirmation and review that for all errors.

 Requesting a quote: Travel with the Magic and its agents/independent contractors do our best to give you the most cost effective option available to you for the travel dates you provide us with. We can not guarantee quoted prices by phone or email until held by deposit. The final pricing is subject to change in the event of tax rate changes or other variables beyond our control. We are not responsible for price increases, room category, and cabin category availability on the part of the travel supplier between the time of your quote request and booking. This includes cost increase, tax increase or errors in pricing by the supplier.

 Currency: All rates, quotes, and payments are in US dollars.

 Issues: All lawsuits in connection with, or incident to, this Terms of Sale/Terms & Conditions shall be litigated, if at all, in the courts of the Country of United States, State of Massachusetts, Essex County, to the exclusion of other courts of any other state.

Upon cancellation of the transportation or travel services, where the passenger is not at fault and has not canceled in violation of any terms and conditions previously clearly and conspicuously disclosed and agreed to by the passenger, all sums paid to the seller of travel for services not provided will be promptly paid to the passenger, unless the passenger advises the seller of travel in writing, after cancellation. This provision does not apply where the seller of travel has remitted the payment to another registered wholesale seller of travel or a carrier, without obtaining a refund, and where the wholesaler or provider defaults in providing the agreed-upon transportation or service.

 Payments: Travel with the Magic DOES NOT ACCEPT PAYMENTS OR CHARGE THE CLIENT DIRECTLY. Your payments are processed by the supplier and we do not accept cash, checks, or credit cards directly. If you pay by check it is made payable to the supplier and mailed to the supplier directly. All credit card or debit card payments are processed by the Supplier. Travel with the Magic provides the Supplier with the clients billing address and information and then they charge the client. There are never charges from Travel with the Magic.
